How will Northern Ireland’s interim ‘Personal Injury Discount Rate’ – the lowest in Europe - impact on catastrophic or life-changing injury claims?

01 November 2021

As the number and pace of litigation cases increases in a post lockdown world, changes to Northern Ireland’s personal injury practice and procedures could have a major impact on both claimants and the wider insurance industry.

As the number and pace of litigation cases increases in a post lockdown world, changes to Northern Ireland’s personal injury practice and procedures could have a major impact on both claimants and the wider insurance industry.

The changes and their repercussions, which could see substantial increases in the compensation sums awarded to those suffering catastrophic or life-changing injuries, will be the focus of a sector-wide virtual conference, delivered by global legal business, DWF (Thursday 11 November).

Central to the conference will be the Dept. of Justice’s decision to reduce Northern Ireland’s Personal Injury Discount Rate (PIDR) to an interim rate of minus 1.75%, which is the lowest in Europe.

As a result, large loss compensation claims could be more than double the equivalent figures paid in NI prior to the introduction of the interim rate.

According to Robin Johnston, Partner in DWF and one of NI’s leading experts in defence litigation, the lessons for insurers, public bodies and large corporations are many.

“PIDR, psychiatric injuries, investigations and defending credit hire claims are all hot topics, with each impacting on insurers, corporate organisations, public sector bodies, and of course, the individuals affected by serious accident or injury.

“In bringing together leading experts from the worlds of medicine, psychiatry, investigations, and accountancy, our forum will unpick the facts from the fiction and provide valuable insights into how we best manage the claims process in NI’s changing legal landscape.”

The virtual Insurance Conference runs from 1-5pm on 11 Nov. DWFs team will be joined by expert speakers who will present their latest insights on PIDR, Investigations, Psychiatric Claims and Credit Hire across four bespoke webinars.
