Civil Sanctions – what do they mean for your business?  Civil sanctions have long played a role in environmental law, but their significance is rapidly increasing as more regulators adopt and expand their use. From the CMA’s new powers under the DMCCA - including potential fines of up to 10% of global turnover -  to higher thresholds from environmental regulators, the landscape is shifting fast. 
 
Now, we expect civil sanctions to become a primary enforcement tool for product safety following the PRAM Act, it has never been more important for businesses to understand the implications. We’ll explore what these sanctions mean in practice, how they may affect your organisation, and the steps you should take if you receive one. 
 
Using Dairy Denominations on Non Dairy Products: Insights from the Supreme Court’s February Judgment – on 11 February we saw the much anticipated Supreme Court decision in Dairy UK Ltd v Oatly AB, offering long awaited clarity on the use of protected dairy terms - such as “milk” - in relation to non dairy products. 
 
The case centred on Oatly’s attempt to register “Post Milk Generation” as a trade mark, which was ultimately blocked on the basis that using the word “milk” in this context would be prohibited. As trade marks cannot be registered for terms whose use would be unlawful, the ruling reinforces important limits for businesses operating in the dairy alternative sector. We’ll break down what Dairy UK’s victory means for branding, marketing claims, and the use of dairy words going forward. 
 
Spotlight on regulation in France: 
France continues to play an active role in shaping the wider European regulatory environment. In this session we will take a look at recent and upcoming updates that are relevant to businesses operating in or trading with France: from the transposition of Directive (EU) 825/2024 empowering consumers for the green transition to recent litigation on meat terms and infant formula recalls.
