Group litigation is attracting high-level interest and activity across the UK

Scotland is seeing some significant shifts in the group litigation space just now. With the first contaminated talc group action raised in the Court of Session, and the Scottish Civil Justice Council closing its consultation on a potential opt out class action regime, it’s clear that mass claims are becoming a much bigger feature of the litigation landscape.

These developments will have real implications for insurers, public bodies and businesses operating in Scotland — particularly as claimant activity continues to grow across product liability, environmental exposure, data breaches and systemic claims.

In England and Wales, an uptick in group litigation has been observed in relation to potential claims against sport governing bodies in the rugby and football head trauma cases, all the subject of a Group Litigation Order in the High Court.  

We are keeping a close eye on the increasing reliance on AI to assist in group litigation, for data analytics and in relation to disclosure.

Against that backdrop, I’m pleased to introduce our ACE Group Litigation team led by Katrina Boyd. The group brings together colleagues with deep experience in handling complex, high value and multi party disputes. Our focus is on giving clients early insight, clear strategy and commercially grounded advice as these types of claims evolve. We are already supporting clients with emerging risks, cross border issues and the practical challenges that come with group proceedings across the UK.
