Working closely with the Inquest team we are able to advise on best interest and capacity issues and, where required, manage Court of Protection applications on either a planned or emergency basis. Other experience includes complex discharges from hospital, overseas visitors' advice through to threatened judicial review proceedings.
Our clients include prison healthcare providers, NHS Trusts, insurance and the social care sector. Our experience includes:
- Representing an acute Trust when a patient referred to the Trust for specialist treatment refused to return home upon completion of her treatment. She lived 100 miles away by the coast but as her daughter lived close to the hospital she refused to leave it. A pre action eviction notice was issued to the patient whereupon she agreed to the planned discharge home;
- Supporting Acute Trusts when applications have been made by Local Authorities to detain infectious patients at a hospital site;
- Disclosure of medical records by healthcare clients as part of ongoing police investigations;
- Making an application under the High Court’s inherent jurisdiction regarding parents’ refusal to allow their child to undergo investigations to inform a lifesaving treatment regime;
- Advising healthcare providers on advanced decisions made by prisoners regarding end-of-life care;
- Assisting an Acute Trust that was an interested party concerning the Local Authorities’ alleged failure to assess and provide an appropriate care package to a disabled teenager, resulting in a delayed discharge from an Acute Trust for 12 months (complicated by intermittent threats by the Official solicitor to make applications against the Trust for not acting in the best interests of the teenager).
