The legal argumentation prepared by DWF's lawyers gained recognition by the Regional Court in Warsaw hearing the case at first instance, which ruled in favour of Mostostal Warszawa S.A. by dismissing the claim against the client in its entirety, at the first hearing.
In particular, the court approved the argumentation developed by DWF's lawyers regarding the statute of limitations of the claim covered by the statement of claim and the impossibility of interrupting the course of the statute of limitations by means of a sham, i.e. not containing settlement proposals, motion for conciliation.
The project was supervised by Michał Szumbarski (Counsel), an advocate specialising in litigation relating to the construction sector and capital markets, with the support of Przemysław Budny (Associate), an advocate trainee specialising in construction disputes, and other lawyers from the Dispute Resolution and Arbitration Department of DWF in Poland.
