Mandatory e-Delivery from April 1, 2025

From April 1, 2025, all businesses will be required to have an electronic delivery mailbox.

1. What is e-Delivery and who is required to have an e-Delivery mailbox?

E-Delivery is a system that enables the electronic exchange of official correspondence, replacing traditional registered mail. This digital communication method enhances efficiency and eliminates the risk of document loss. The requirement applies to all entities registered in the KRS, including limited liability companies, joint-stock companies, limited partnerships, and limited joint-stock partnerships. It also extends to general partnerships with legal personality, as well as foundations and associations.

2. How to set up an e-Delivery mailbox?

Businesses can use the free public provider service via the “Entrepreneur Account” on Biznes.gov.pl to set up their e-Delivery mailbox. The application for an e-Delivery address can be submitted in the following ways:

(a) through the e-service on Biznes.gov.pl,

(b) when registering a company via an application to CEIDG or KRS,

(c) by updating an existing CEIDG or KRS entry if the company was registered before January 1, 2025.

Private entrepreneurs can apply via Biznes.gov.pl, while public entities and professionals in regulated professions must use the e-service available on gov.pl.

Once activated, all official correspondence will be received electronically. We draw attention to the need for a carefully considered decision regarding the choice of an email administrator who will be responsible for the ongoing management of the mailbox!

3. What are the consequences of not setting up an e-Delivery mailbox?

Failure to set up an e-Delivery mailbox may result in difficulties receiving official documents, and letters may be deemed delivered even if they are not opened. Additionally, businesses that fail to comply with this requirement may face financial penalties.
