Aviva and DWF win Claims Collaboration of the Year for 2023

17 October 2023

DWF's relationship with Aviva goes from strength to strength as they win the Claims Collaboration of the Year award at the Insurance Post and Fraud Awards 2023.

Aviva and DWF jointly received the 'Claims Collaboration of the Year' award for their fantastic work, which culminated in setting an industry precedent in the pioneering case of Khan v Aviva.

Aviva and DWF joined forces to combat an epidemic of rehabilitation layering within the insurance industry, analysing vast amounts of data and developing a Rehabilitation Data Profiler, which exposed toxic combinations of enablers – specifically medico-legal experts and developed strategies to tackle those enablers.

In Khan v Aviva, the results of Aviva / DWF's analysis of data and demonstration of similar fact evidence led the judge to conclude that there was clear evidence of collusion between the Claimant / Solicitors / medical agencies and in a trailblazing decision accepted that data driven similar fact evidence can be used to combat adverse behaviours in layering which has set the platform for others to be able to significantly reduce indemnity spend.

Aviva / DWF repudiated over 4,700 claims with savings of over £5m.

Waseem Malik, Chief Claims Officer, Aviva said "It is delightful to see the outstanding result that the collaboration between our respective teams at Aviva and DWF Law LLP has achieved.  This further reinforces Aviva's robust approach to fighting fraud where we find it, and working with the right partners to do so".

Miles Hepworth, Partner, DWF said "This is a significant judgment with it being the first to properly raise awareness within the industry and the judiciary of the wider practices at play in the current claims environment. It highlights that claims are less about claimants, and more about the entities behind the claims".

This award is celebrated by DWF as an example of the strengthened relationships, gained and nurtured through such industry – wide projects. For more information about how DWF's Counter Fraud team can support your needs, please visit DWF Fraud
