Oleksandra Vytiaganets

Oleksandra is an associate at DWF's dispute resolution team in the UK. She is a dual-qualified lawyer (England & Wales and Ukraine) with practical experience in both jurisdictions specialising in commercial and investment arbitration and complex cross-border litigation matters. She holds a Ph.D. degree in international investment law, frequently speaks at international events, and publishes on the subject of international arbitration. She is a native Ukrainian and Russian speaker and is fluent in English.

Experience

Oleksandra has extensive experience in various sectors, including banking, retail, energy, mining, water, construction, housing, and agriculture. She has handled complex cases involving issues of fraud, assignment, trust, joint venture, partnership, and breach of fiduciary duty. Her work spans multiple jurisdictions, including Ukraine, Switzerland, Cyprus, Germany, the US, the BVI, Ivory Coast, Dubai, and Saudi Arabia, advising on cases involving English and Ukrainian law.

Some of her notable cases include advising a deposit guarantee fund in a complex fraud litigation in respect of the recovery of over $1 billion assets of a defunct bank in Eastern Europe involving the UK, Hong Kong and other jurisdictions. She advised Dutch and UK investors in an international investment arbitration against an Asian host state arising out of alleged expropriation of bank shareholding rights. She also acted in various commercial arbitration matters, including a $450m LCIA arbitration between Russian and Ukrainian individuals relating to partnership and breach of fiduciary duty and a multi-million CIArb arbitration brought by a grocery manufacturer against a UK listed retailer involving alleged breaches of GSCOP.

Oleksandra provides legal opinions on various issues of Ukrainian and English law, showcasing her versatility and broad expertise in various legal matters. She has recently acted as an expert on Ukrainian law in connection with the enforcement of a substantial $170 million post-2022 judgment against a Russian state entity in New York, USA. 

In addition to her professional work, Oleksandra is actively involved in pro bono initiatives, including advising NGOs in relation to the UN Framework Convention on Climate Change and mentoring Ukrainian lawyers transitioning their careers in the UK.

  • Providing expert opinion on Ukrainian law in relation to enforcement of a $170m judgment against a Russian state entity in the US (NY). 
  • A multi-million CIArb arbitration brought by a grocery manufacturer against a UK listed retailer involving alleged breaches of GSCOP.
