While there have been a handful of significant GDPR fines, Data Protection regulatory enforcement action continues to stagnate, but momentum for compensation claims and litigation is increasing. The Privacy Activist and the Claims Farms seem to be on the same side of the pitch, utilising the same legal mechanisms in the same areas of the law, for the same reasons, to create legal accountability for perceived infringement of Data Protection, Privacy and Cyber Security laws and failures of operational good practice.
In the UK, social media campaigns to drum-up claimants for group litigation are now a fact of life, while privacy activists are pursuing pan-European legal campaigns to pursue their agendas. Underpinning both models are complex economic frameworks, where the farmer and the activist can be reliant on the same funders to pursue businesses and governments alike.
