Experience

Maciej provides legal advice to entities involved in greenfield and brownfield investments including hard and social infrastructure. He is experienced in advising on projects and transactions carried out in all key infrastructure sectors, including oil&gas, energy, seaports, motorways, railways, mass transportation, waste management, IT, water and sewage, as well as nuclear energy. 

He provides advice on all types of investments into infrastructure assets, including acquisition, construction, development and revamp, public-private partnerships and concessions, construction works contracts, O&M contracts, public service contracts, technology transfer agreements, supply contracts, and off-take agreements, day-to-day operations of utility companies, public law and public procurement. 

Maciej also represents Clients in dispute resolution before common courts and arbitration tribunals concerning projects & infrastructure. He also guides Clients through negotiations of settlements and pre-trial negotiations.

Maciej also advises companies in criminal compliance area and proceedings related to business crimes. His experience and practice include in particular advising companies and organisations on the preparation of internal regulations, rules of procedure and compliance procedures. He also specialises in developing strategies in the field of enterprise management in crisis situations.

For several years he has been recommended by Chambers & Partners and Legal500. Maciej is also a lecturer at the Warsaw School of Economics.

  • Strategic advisory and preparation of the contracting strategy for the development of the large-scale nuclear power plant.
  • Acting as a leading counsel in drafting and negotiation of the development contracts for the large-scale nuclear unit, including contracts for engineering, design and preparatory works (FEED, pre-EPC).
  • Strategic advisory related to the technology selection and regulatory matters, including procurement issues on the European Commission level.

Energy 

  • Leading counsel in the project related to the development of the gas-fired power plant of over 900 MW power output, including strategic advisory, preparation and negotiation of the EPC, LTSA and contracts for associated infrastructure, permitting and licensing strategy, as well as claim management.
  • Leading counsel in the project related to the development of the CCGT Power Plant, including preparation and negotiation of the EPC, LTSA and contracts for associated infrastructure, permitting and licensing strategy, as well as claim management.
  • Drafting and negotiation of the EPCM contract related to the gas fired unit project abandoned by its initial contractor.
  • Drafting and negotiation of the series of power purchase agreements (PPA).
  • Drafting and negotiation of the EPC contract for the development of the energy storage unit.

Oil & Gas 

  • Acting as a leading counsel in the split-EPC project related to the extension of the LNG Terminal, including negotiation of the principal contracts and claim management.
  • Advisory, preparation and negotiation of the long-lead items contract related to the development of the LNG Terminal.
  • Advisory preparation and negotiation of the contract related to the development of the gas storage unit.
  • Drafting, negotiation, day-to-day advisory and claim management related to the development of the petroleum process station.

Waste management 

  • Leading counsel in the project related to the development of the WtE plant in the PPP formula, including negotiation of the PPP, EPC, O&M and financing contracts, permitting and licensing strategy, as well as claim management.
  • Strategic advisory related regarding contracting and licencing strategy for the municipality investor in the project related to the development of the biogas plant.
  • Representing the client in all instances of the proceedings related to the decision on the environmental conditions for consent to the implementation of the project.

Dispute resolution and arbitration 

  • Representing a leading firm from the oil&gas industry in multi-billion dispute against consortium of foreign contractors related to the development of the power plant.
  • Representing real estate investor in multi-million dispute related to the performance of DMA agreement.
  • Representing a leading firm from the chemical industry in multimillion dispute against foreign contractor related to the development of fertilizers production unit. 

Commercial criminal proceedings 

  • Advised and represented an international aviation and defense industry company in complex criminal proceedings regarding a potential tender conspiracy.
  • Advised and represented international a company from the telecommunication industry in complex, international criminal proceedings regarding potential fraud and money laundering.
  • Advised and represented management board members of financial sector companies in proceedings related to an alleged breach of trust towards the company.
