Vento bands: Revised bands of compensation for injury to feelings

The Presidents of the Employment Tribunals have published the revised bands of compensation for injury to feelings in discrimination cases. 

England and Wales

The new bands are as follows:

  • Lower band – £900 to £8,800 for less serious cases
  • Middle band –£8,800 to £26,300 for cases that do not merit an award in the upper band
  • Upper band – £26,300 to £44,000 for the most serious cases
  • Exceptional cases – £44,000 or above

The new bands apply to claims presented on or after 6 April 2019 and will be reviewed annually.

 

Scotland

In respect of claims presented in Scotland, the bands remain subject to paragraph 12 of the Presidential Guidance issued on 5 September 2017. The Guidance states that if the tribunal decide that the Simmons v Castle 10% uplift should not apply, the award should be adjusted accordingly.
