Mark is a commercial disputes specialist with particular expertise in property disputes, professional negligence cases, debt recovery and insolvency actions, commercial contract disputes, planning and judicial review.

Experience

He advises local and national businesses and private clients on a wide range of commercial and property-related disputes in Northern Ireland and in England and Wales.

Mark's approach is generally to be as constructive as circumstances allow, with the aim of resolving disputes with a minimum of time and cost incurred by his clients.

Clients rely on his advice in a broad range of property disputes, including landlord and tenant disputes, disputes over property rights and professional negligence claims against contractors, professional teams, managing agents and solicitors. He has also acted for developers and commercial landlords in relation to planning disputes.

A substantial part of Mark's work is acting for local and national banks and leading insolvency practitioners in insolvency and debt matters in the High Court and Court of Appeal, which have on occasion included mis-selling and breach of duty claims in the financial services sector.

He also regularly acts in cases in which banks take action against borrowers' solicitors and have given in-house training to banks in connection with such actions.

On the corporate side, Mark has acted in a number of shareholder disputes and post-acquisition breach of warranty claims. He has also acted for charities in relation to substantial restructuring.

As the spectrum of clients' advisory requirements is as broad as the spheres in which they operate Mark has also acted in a range of other areas, including a tax case which resulted in a UK-wide change of HMRC guidance in relation to Transfers of Going Concerns, high value fraud cases, and for NAMA and a local bank in leading cases involving the operation of the NAMA scheme in Northern Ireland.

When Mark's two children aren't in need of his taxi services, he enjoys reading history and fiction, playing golf and supporting Ulster Rugby and Liverpool FC.
