‘Deemed unsafe’ ruled irrebuttable by High Court in respect of food beyond its use by date: In ruling on an application made by Jonathan Kirk on behalf of Tesco PLC in a prosecution for out of code food brought by Birmingham City Council the High Court has found that both as a matter of ordinary language, and by reference to the purpose of the EU Regulations, the correct meaning of the words in issue in article 24 of the Food Information Regulation is that food passed its use by date is unsafe for the purposes of article 14 of the Food Safety Regulation.
